I think this is actually supposed to be Dick Grayson as Red Robin/Kingdom Come Red Robin. Either him or Jason Todd. He doesn’t use the “teenager” body from what I can see, and as the strip points out his facial sculpt is considerably more…mature.
At least 17 is close to legal, and in some places is over the age of consent (depending on many conditions, of course). As for the toy… I think the comic speaks for itself.

FYI I happen to live in one of those states where the age of consent is 18 so the thought of 15-year-olds having sex with adults is still a bit disturbing to me. But I guess age of consent is completely arbitrary so, whatever, to each their own.

I thought of that too, but if you look it up, the entire rest of the series that figure is in is DCNU figures. The costume’s sculpt is also closer to the current Red Robin, with less detailed boots and belt.

This reminds me of back when Tim Drake Robin got first got a series in the 90′s(?) one of the comments I recall was the artist actually drew Tim looking like a teenager as opposed to many who drew teens as sorta scrawnier adults and how refreshing it was to see teens not look like they’re 40 years old.
Robins age like women in anime. By the time you’re 12, you look like you’re thirty in the real world.

Actually it’s at-or-above the age of consent in nearly every state in the Union. 28 States (+ D.C.) have it at 16. 10 states have it at 17.
Only 12 states have their age of consent set at 18.
